act<br><br><\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-bd93bc4 elementor-widget elementor-widget-text-editor\" data-id=\"bd93bc4\" wpb_content_element \"><div class=\"wpb_wrapper\"><div class=\"grid_12 \"><p>The Bankruptcy Act and the Enterprise Continuity Act merge into one and are integrated together into the Code of Economic Law.<\/p><p>In addition, points were thoroughly modified and a number of punctual adjustments were made.<\/p><p>The law dates from 11 August 2017 and came into force on 1 May class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p>Scope<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-56dec27 elementor-widget elementor-widget-text-editor\" data-id=\"56dec27\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p>The notion of \u2018enterprise\u2019 is being significantly broadened. Previously, it was only about \u2018commercial\u2019 companies. From now on,  <\/p><div class=\"separator transparent center \"> <\/div><ul><li>any natural person who pursues a professional activity as a self-employed person, including managers and directors in companies and professions, will be considered to be an enterprise. This is an important step forward as many professions face financial difficulties <\/li><li>any legal person, without taking into account whether or not it engages in a commercial activity. Non-profit organisations, agricultural companies and foundations will therefore also be able to benefit from the new law <\/li><li>Every organisation without legal personality except governments<\/li><\/ul>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-b83508b elementor-widget elementor-widget-text-editor\" data-id=\"b83508b\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p>Second chance<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-9afe9d8 elementor-widget elementor-widget-text-editor\" data-id=\"9afe9d8\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p>The new law aims to facilitate a faster restart of a new activity, provide a better \u2018second chance\u2019 and stop the stigmatisation. While bankruptcy was also literally described as a \u2018failure\u2019 previously, bankrupt entrepreneurs will henceforth be considered as persons who have gained experience, with a higher chance of success in the future. <\/p><p> <\/p><p>It concerns the so-called \u2018excusability\u2019. Previously, it took months or even years for the entrepreneur in question to be exempted from the fault of bankruptcy. The new law replaces excusability with a faster debt forgiveness.  <\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-8516cf7 elementor-widget elementor-widget-text-editor\" data-id=\"8516cf7\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p>Digitisation<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-e5d9f74 elementor-widget elementor-widget-text-editor\" data-id=\"e5d9f74\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p>The legislature has also used this reform to further focus on the thorough digitisation of insolvency proceedings. For example, the Central Solvency Register, which was launched in April 2017, will henceforth also be used as a database for insolvency proceedings other than bankruptcy. <\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-73fc21c elementor-widget elementor-widget-text-editor\" data-id=\"73fc21c\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p>Amicable agreement renewal<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-40b14f2 elementor-widget elementor-widget-text-editor\" data-id=\"40b14f2\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p>The amicable agreement guarantees a creditor that he can keep the amounts already received. If such a settlement is declared enforceable, the creditor may \u2013 if the debtor does nothing \u2013 enforce the execution in court. <\/p><p> <\/p><p>From now on, a debtor who is in a difficult financial situation and is unable to put things in order himself can now call on a business mediator to assist him in negotiating an agreement with his creditors.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-1bffafe elementor-widget elementor-widget-text-editor\" data-id=\"1bffafe\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p>Cross-border insolvency<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-924c9b4 elementor-widget elementor-widget-text-editor\" data-id=\"924c9b4\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p>The new law also introduces new rules on cross-border insolvency and corporate groups under the European Insolvency Regulation, in order to address a number of practical problems that may arise in this context.<\/p><p> <\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-383e088 elementor-widget elementor-widget-text-editor\" data-id=\"383e088\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p>Extension of directors\u2019 liability<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-bed5d71 elementor-widget elementor-widget-text-editor\" data-id=\"bed5d71\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p>Legislature has also made some changes to directors\u2019 liability in such a way that directors of all companies can be held liable.<\/p><p> <\/p><p>Of course, this new law will affect the statistics on bankruptcies.
